RESPONDENT. : STIPULATED CONDITIONAL REGISTRATION AGREEMENT The Department of Business Regulation (“Department”) and the Respondent (the “Parties”) enter into this Stipulated Conditional Registration Agreement and hereby agree to resolve this matter as follows: 1. On or about June 01, 2025, the Contractors’ Registration and Licensing Board (“Board”) received complaint number 25-134, related to a construction project located in Cranston, Rhode Island. 2. Based upon an investigation into complaint number C-25-101, conducted by William Shurick, Chief Investigator for the Contractors’ Board, it has been substantiated that Respondent violated the statutory and/or regulatory requirements seq., and 440-RICR-10-00-1 and 440-RICR-10-00-2, as follows: a. Withheld entirety of deposit paid pursuant to construction contract and failed to perform any aspect of the construction work or deliver any materials to the project site. R.I. Gen. Laws §§ 5-65-10(a)(10). 3. While Respondent neither admits nor denies to committing the above violations, it is the Board’s position that had a hearing been held in this matter, it would have demonstrated by a preponderance of the evidence that Respondent violated R.I. Gen. Laws § 5-65-1 et seq., as detailed above. TERMS AND CONDITIONS 4. In order to amicably resolve this matter without an administrative hearing, the Parties hereby enter into this Stipulated Conditional Registration Agreement solely for the purpose of avoiding the burdens and expenses of litigation. The Parties agree to resolve this matter based upon the following: a. Respondent agrees to refund the consumer involved in complaint number C-25-134, a total of $14,861.59 (representing the $18,000 deposit paid to the Respondent sans $3,138.41, spent to secure a pool liner for the project). b. Respondent shall complete payment to the complainant involved in C-25-134 by October 1, 2026.
