He wrote that he had been asked for 50% down; another commenter replied that Massachusetts caps the deposit on a home project over a thousand dollars at a third. He also wrote that the company could not give him a clear date for a Trex gate and then suggested making the gate itself, after telling him it had never made a Trex gate — and that when the company said Trex Fencing FDS and Trex Fencing SRF had merged, he called both suppliers and both said they had not. For a straightforward vinyl or wood fence line this is a local, licensed shop. Before signing, put the deposit and the payment schedule in writing at the legal limit, name the supplier and the lead time for any Trex or custom gate on the contract itself, and check registration #212245 on the state's own register.

“Not legal advice but he said they grabbed 50% though and MGL Chapter 142A, any home project over a thousand bucks has a strict 1/3 deposit cap, so Superior Fence telling him they need 50% down for the whole job is flat out wrong'. Fence companies dont have to pay a state fee to register for an HIC ID number under l201 CMR 1801, but MA consumer affairs is super clear that this registration shortcut doesnt let them off the hook for the actual contract and deposit laws.
